A federal grand jury has indicted Jose Urena-Capellan, 40, of Allentown, Pennsylvania, on a drug trafficking charge. According to Acting United States Attorney John C. Gurganus for the Middle District of Pennsylvania, Urena-Capellan is accused of attempted possession with intent to distribute 400 grams or more of fentanyl in Franklin County on July 30, 2025.
The investigation was conducted by the United States Postal Inspection Service and the Pennsylvania State Police. Assistant U.S. Attorney Scott Ford is prosecuting the case.
“This case is part of Operation Take Back America, a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime. Operation Take Back America streamlines efforts and resources from the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN),” according to information provided by officials.
If convicted under federal law, Urena-Capellan could face a maximum penalty that includes life imprisonment, a fine, and supervised release after imprisonment. Sentencing will be determined by a judge based on federal statutes and guidelines.
Authorities emphasize that indictments are only allegations. “All persons charged by indictment are presumed to be innocent unless and until found guilty in court.”
