A delivery worker is seeking damages after suffering serious injuries from a slip and fall on an icy driveway, claiming that the property owners failed to maintain safe conditions. The complaint was filed by Larson A. Hibbert in the Court of Common Pleas of Delaware County, Pennsylvania, on March 23, 2026, naming Ashley Bottari and Ruperto Alvarado as defendants.

According to the civil action complaint, Hibbert alleges that on February 27, 2026, at approximately 10:00 a.m., he was delivering packages to the premises located at 105 Bryn Mawr Avenue in Newtown Square when he slipped and fell on a patch of ice in the driveway. The plaintiff states that he was taking what appeared to be the safest path toward the entrance when the incident occurred.

The complaint outlines that both defendants owned, possessed, controlled, supervised, managed, maintained or operated the property at the time of the incident. Hibbert claims that Bottari and Alvarado either knew or should have known about the hazardous ice condition because it had been allowed to accumulate without removal or treatment for what he describes as “an unreasonably long time.” The filing further asserts that this created a dangerous situation not obvious to pedestrians using the driveway.

Hibbert argues that it was legally incumbent upon Bottari and Alvarado to ensure regular inspection and maintenance of their driveway—including clearing snow and ice or applying substances such as rock salt or sand—to make it reasonably safe for visitors. The lawsuit details several alleged failures by the defendants: “failure to adequately warn pedestrians such as Plaintiff of ice accumulations; failure to adequately barricade or section off the ice portions of the subject driveway; failure to reasonably clear the ice from the driveway area where Plaintiff fell… allowing the ice to remain for an unreasonably long time; failure to provide an alternative, safer route… [and] negligence per se for violation of local city ordinance for failure to clear, sand or salt the ice in a timely fashion.”

As a direct result of these alleged acts and omissions, Hibbert reports suffering significant injuries including “fracture of the left fibula requiring surgery with installation of hardware” and a “dislocated left ankle,” among other injuries causing pain and loss of enjoyment of life. He also claims ongoing effects such as inability to perform daily activities fully and loss of work time due to his injuries.

The complaint states that Hibbert has incurred medical expenses related to surgeries and treatments following his fall and may continue needing additional procedures in future. It also notes healthcare liens asserted against him as part of his economic losses.

Hibbert seeks judgment against Bottari and Alvarado individually as well as jointly and severally for an amount exceeding $50,000.00. He requests compensation for his physical injuries, pain and suffering, lost wages, medical costs, diminished quality of life, and any liens resulting from medical care related to his injury.
