A federal grand jury has indicted Eduardo Domingo-Aguilar, a 38-year-old citizen of Guatemala, for illegally reentering the United States after previously being removed. The announcement was made by the United States Attorney’s Office for the Middle District of Pennsylvania.

According to United States Attorney Brian D. Miller, Domingo-Aguilar was found in Franklin County, Pennsylvania on September 23, 2025. Authorities allege that he had been previously removed from the country through San Antonio, Texas around September 21, 2015 and returned without obtaining legal permission.

The investigation was conducted by U.S. Immigration and Customs Enforcement and Removal Operations. Assistant United States Attorney Kelley K. McGraw is prosecuting the case.

This prosecution is part of Operation Take Back America, a national initiative that brings together resources from across the Department of Justice to address illegal immigration and related criminal activities such as drug cartels and transnational criminal organizations. The initiative coordinates efforts with programs like the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN). More information about Operation Take Back America can be found at https://www.justice.gov/dag/media/1393746/dl?inline.

If convicted, Domingo-Aguilar faces a maximum sentence of two years in prison, supervised release following imprisonment, and a fine. Sentencing decisions are made by a judge who considers federal sentencing statutes and guidelines.

Authorities emphasized that indictments are only allegations and all persons charged are presumed innocent unless proven guilty in court.
