Honduran national indicted for illegal reentry into Pennsylvania

A federal grand jury has indicted Marvin Cornejo Hernandez, a 40-year-old citizen of Honduras, for allegedly reentering the United States illegally after previously being removed. The announcement was made by the United States Attorney’s Office for the Middle District of Pennsylvania.

According to United States Attorney Brian D. Miller, the indictment claims that on or about January 27, 2026, Mendoza-Hernandez was located in Franklin County, Pennsylvania. He had previously been removed from the United States through Brownsville, Texas on April 29, 2019 and is accused of returning without legal authorization.

The investigation was conducted by U.S. Immigration and Customs Enforcement and Removal Operations (ERO). Assistant United States Attorney Kelley K. McGraw is prosecuting the case.

This prosecution falls under Operation Take Back America, a national initiative using Department of Justice resources to address illegal immigration and combat cartels and transnational criminal organizations while aiming to protect communities from violent crime perpetrators. If convicted, Hernandez faces a maximum penalty of two years in prison, supervised release following imprisonment, and a fine. Sentencing will be determined by a judge based on federal statutes and sentencing guidelines.

“Indictments and Criminal Informations are only allegations. All persons charged are presumed to be innocent unless and until found guilty in court,” stated the U.S. Attorney’s Office.
