A Johnstown, Pennsylvania resident has pleaded guilty in federal court to theft from a program receiving federal funds, according to First Assistant United States Attorney Troy Rivetti.

Brett Smith, 41, admitted guilt to one count before United States District Judge Stephanie L. Haines on October 1, 2025. Smith previously managed an apartment complex in Johnstown that serves elderly residents and receives funding from the U.S. Department of Housing and Urban Development (HUD) through Section 8 Housing Assistance Payments.

According to information presented in court, Smith deposited rental payments and laundry machine coins from the federally funded complex into his personal bank account.

Sentencing is set for February 3, 2026. The offense carries a maximum penalty of up to ten years in prison and a fine of $250,000 or an alternative amount. The actual sentence will be determined based on the seriousness of the crime and any prior criminal history under federal Sentencing Guidelines.

Assistant United States Attorney Nicole A. Stockey is prosecuting the case. The investigation was conducted by the HUD Office of Inspector General and the Federal Bureau of Investigation.
