A Pennsylvania couple has taken legal action following a severe injury sustained on another couple’s property. On November 12, 2025, Edward and Maria Monaghan filed a complaint in the Court of Common Pleas of Delaware County against Joseph and Sally Rufo. The Monaghans allege that the Rufos’ negligence led to a debilitating injury for Edward Monaghan.

The incident occurred on July 31, 2025, at the Rufos’ residence located at 310 Brookline Boulevard in Havertown, Pennsylvania. According to the complaint, Edward Monaghan was visiting the premises when he unknowingly stepped onto a defective driveway surface. This unfortunate event resulted in Edward suffering from a fractured left femur, necessitating invasive surgery and the implantation of metal fixation devices. The plaintiffs assert that this injury was directly caused by the Rufos’ failure to maintain their property safely and properly.

In their legal filing, the Monaghans outline several accusations against Joseph and Sally Rufo. They claim that the defendants neglected their duty to ensure that their driveway and surrounding areas were safe for visitors. Furthermore, they argue that there was no warning provided about the hazardous condition of the driveway surface. As a result of these alleged oversights, Edward Monaghan has endured significant physical pain and limitations on his mobility and quality of life.

The plaintiffs are seeking damages exceeding $50,000 for each count presented in their lawsuit. They are pursuing compensation not only for Edward’s medical expenses and permanent injuries but also for loss of consortium experienced by both Edward and Maria as a result of this incident. The Monaghans argue that their marital relationship has suffered due to the consequences of Edward’s injuries.

Representing the plaintiffs is McNichol, Byrne & Matlawski, P.C., with attorneys James J. Byrne Jr. and Michael J. Hawley taking charge of the case. As this legal battle unfolds in front of Judge [Name], it will be determined whether Joseph and Sally Rufo will be held accountable for the claims brought against them under Case ID NO.CV- [Case Number].
