A dangerous sidewalk condition has led to a legal battle in Delaware County, Pennsylvania. On November 7, 2025, Kimberly Strunk filed a complaint in the Court of Common Pleas against Leon Hosier, Janet Hosier, and unidentified individuals referred to as John Doe Nos. 1-10. The lawsuit accuses the defendants of negligence that resulted in severe injuries to Strunk during her daily walk.

The incident occurred on May 25, 2025, when Strunk tripped over a protruding metal spike on the sidewalk adjacent to the defendants’ property at 100 Upland Road, Brookhaven. According to the complaint filed by Morgan & Morgan PLLC, the spike was unmarked and difficult to see against the gravel and asphalt surface. This hazardous condition allegedly created an unreasonable risk for pedestrians like Strunk who were lawfully using the sidewalk. As a result of this fall, Strunk sustained multiple fractures in her right hand and fingers, requiring surgical intervention and ongoing medical treatment.

Strunk’s attorneys argue that the defendants were responsible for maintaining a safe environment on their property but failed to inspect or repair the dangerous condition. The complaint states that “Defendants knew or should have known” about the hazard and neglected their duty to warn or protect pedestrians from it. Furthermore, it claims that despite having notice of this defect, no corrective measures were taken by those responsible for property maintenance.

In her lawsuit, Strunk seeks damages exceeding $50,000 for her injuries and associated losses. She claims diminished earning capacity due to her inability to work post-incident and anticipates future medical expenses related to her recovery. The suit also highlights emotional distress caused by physical pain and limitations resulting from the accident.
