A Pennsylvania woman has taken legal action against multiple public entities, claiming negligence after a severe accident involving her electric bicycle. Annemarie Borcky filed a civil complaint on November 12, 2025, in the Court of Common Pleas of Delaware County against Penn Dot, the Borough of Collingdale, and the County of Delaware. The lawsuit alleges that these entities failed to maintain a safe roadway environment on McDade Blvd in Collingdale, PA.

According to the complaint, on September 12, 2024, Borcky was riding her electric bicycle near 445 McDade Blvd when she encountered a hazardous hole in the street. This defect allegedly caused her to fall violently onto the road, resulting in injuries to her face, neck, right shoulder, and left knee. The plaintiff claims that the defendants were negligent in their duty to maintain the road safely. The complaint details several accusations against the defendants: failure to properly maintain and monitor the roadway conditions; neglecting to remove hazards or warn about them; and not employing barricades or signs to prevent accidents.

Borcky’s injuries are described as extensive and potentially permanent. She suffered damage to her orbital bone and experienced severe shock affecting her nervous system. Additionally, she reports ongoing physical pain and mental anguish since the incident. Due to these injuries, Borcky asserts that she has incurred significant medical expenses and has been unable to engage in her usual activities or work duties.

The plaintiff is seeking judgment from the court for damages not exceeding $50,000 for arbitration purposes only. This amount aims to cover medical costs and compensate for physical pain, suffering, mental distress, humiliation, disfigurement, and loss of life enjoyment due to her incapacitation.
