Diane and Michael Daulerio have taken legal action against a Pennsylvania university, claiming negligence after a serious accident on the university’s premises. The complaint was filed by the plaintiffs in the Court of Common Pleas of Delaware County, Pennsylvania, on November 7, 2025, targeting Widener University and an unnamed corporation.
The case centers around an incident that occurred on January 8, 2025, when Diane Daulerio visited Widener University’s Schwartz Athletic Center to watch her son play basketball. According to the complaint, Diane parked in a handicapped spot but encountered obstacles due to snow coverage and a blocked entrance. Forced to use a handicap parking sign for support, she fell when the loose sign gave way, resulting in severe injuries including a concussion with post-concussive syndrome and post-traumatic tinnitus.
The plaintiffs argue that Widener University had control over the area where the accident occurred and failed to maintain it safely. They claim that the university was aware or should have been aware of the hazardous condition posed by the loose parking sign. The complaint accuses Widener University of negligence for not addressing these safety issues and failing to warn visitors about potential dangers.
Diane Daulerio is seeking compensation exceeding $50,000 for her injuries, which have caused significant physical pain and emotional distress. Her husband, Michael Daulerio, has also filed a claim for loss of consortium due to his wife’s injuries affecting their marital relationship.
Represented by attorneys Hugh A. Donaghue, Kathryn L. Labrum, and Tyler J. Therriault from Donaghue & Labrum LLP based in Media, PA, the plaintiffs are pursuing damages that include interest and costs associated with their claims. The case has been assigned Case ID No. 2025 in Delaware County’s civil division court.
