According to Heller’s account in court documents, she suffered a distal left tibia fracture requiring surgery as a direct result of her fall. She reports ongoing pain, emotional distress, diminished quality of life, loss of ability to engage in daily activities, humiliation, embarrassment, diminished mobility, medical expenses not covered by insurance, and potential future loss of earnings. The complaint emphasizes both physical injuries—described as “serious impairment”—and emotional harm resulting from the incident.

Each count in the complaint targets different parties: Count I is directed at John Alden Properties LLC; Count II addresses David Gregitis and Rosemarie Gregitis; Count III names John Doe 1-10. In each instance, Heller repeats her claims regarding failure to maintain safe conditions and neglecting necessary repairs or warnings despite having time and knowledge sufficient to address them.

For relief, Heller seeks judgment against all named defendants individually or jointly for an amount exceeding $50,000 plus compensatory damages for her injuries. She also requests punitive damages where appropriate along with interest, fees, costs associated with litigation, “and other relief that this Court may deem just and proper.” No specific injunctive relief is mentioned beyond monetary compensation.
